Filing a Form 18 for North Carolina Workers Comp

The first step in filing for a workers comp claim is to submit a form 18. There are several steps you must take in order to have a workers’ comp case and eventually benefitting from a settlement. What is a Form 18 in a Workers Comp Case?

A Form 18 is a very important document that must be filed in order to have a case for a workers compensation claim. Once form 18 is filed by an employee, the insurer will have a 30-day deadline to admit or deny the claim. They file a form 60 for admission or a form 61 for denial. If the claim is denied, the employee will then have the option to file a Form 33, which is a request for a hearing.

Why Would a Form 18 be Denied by an Insurer?

It is a question of whether or not the claim is compensable. If the claim is denied, they should immediately consult their workers’ compensation attorney to determine if the claim was rightfully or wrongfully denied. According to Mr. Hedrick, about 75% of the claims that are denied can be covered in a workers’ compensation case.

How Long do You Have to File a Form 18?

Form 18 must be filed within 2 years from the date that the injury occurred or it must be filed within 2 years from when the employer or insurer last paid for medical treatment. For example, if an employee was injured on the job and is given medical treatment by the employer, this extends the date to which form 18 must be filed. 

How to File a Form 18?
